What are the legal requirements of a landlord?
As the landlord you have a legal responsibility towards your tenants. In 1985 the Landlord and Tenant Act was created. According to this Act the landlord is compelled to maintain the property and the building in reasonable order which is fit for human habitation. This includes gas, electricity water and sanitary installations etc. are in a safe working condition. The property should have an effective drainage system, with an adequately located toilet and a wash-room with all attachments which should be free from dampness. Heating, lighting and proper ventilation is also a necessity. If in doubt the local council should assure you that the property conforms to the necessary regulations. In order to avoid any legal penalty take immediate action if there are genuine complaints. Further Legislation known as the Installation and use of Gas Safety Regulation in 1994 which was amended in 1996 and 1998, was to make sure that the landlords are legally bound to maintain all gas appliances in reasonable working order. These appliances should be checked by the landlord yearly including electrical equipment and affirm of their safety. For interior décor the landlord will have to use fire resistant furnishings. These are usually labelled as such when you purchase them. The regulation for this (Fire Safety) was brought in 1988 which was again amended in 1989/1993. All kinds of furniture and other accessories in the house are covered by this regulation. Landlord will have to set aside a small sum for maintaining the property. If your property is managed by a letting agent his charges will be more. A limited contents policy would give a fixed amount to the landlord to cover the household items and electrical fittings. Taking liability insurance is a legal necessity for the landlord as it covers both the tenant’s safety and also structure of the house. A substantial comprehensive insurance cover is recommended, which includes any injuries caused by structural and other incidental events. Rent Guarantee Insurance covers your rent if the tenant is unable to pay it, but will have conditions.
